The Burden of Proof is on the Airline
The airline must prove that the disruption was NOT within their control or that it was required for safety purposes.
Canada Transportation Act, Section 85.07(2): “If a complaint raises an issue as to whether a flight delay, flight cancellation or denial of boarding is within a carrier’s control, is within a carrier’s control but is required for safety reasons or is outside a carrier’s control, it is presumed to be within the carrier’s control and not required for safety reasons unless the carrier proves the contrary.”
What this means for you:
- The airline must provide evidence to justify their categorization
- Vague explanations like “operational reasons” or “crew unavailability” are insufficient
- The airline must show specific details and documentation

Under Canada’s Air Passenger Protection Regulations (APPR), you can receive $400 for delays of 3-6 hours, $700 for delays of 6-9 hours, and $1,000 for delays over 9 hours. Compensation amounts depend the delay length, size of airline, and whether the delay was within the airline’s control.
Very unlikely. Weather deelays are considered outside the airline’s control, so APPR compensation does not apply. However, you may still be entitled to meals, hotel accommodation, and rebooking depending on the delay length.
You have one year from the date of the flight disruption to start your complaint with the airline.
No cash compensation is required for delays under 3 hours. However, airlines must provide meals and refreshments for delays over 2 hours, and hotel accommodation for overnight delays, regardless of compensation eligibility.
APPR applies to all flights departing from Canadian airports, regardless of airline.
