Courtready tracked the earliest available hearing dates for selected proceeding types in Toronto from November 1, 2025, to January 31, 2026, using Courtready’s Toronto Court Dates Finder. Here are the key findings.

Associate Judge Motions: 6 to 9 Months on Average

Associate Judge motions in Toronto continue to face significant wait times. Over the three-month tracking period, virtual 75-minute motions averaged 217 days (roughly 7 months), while virtual 90–120 minute motions averaged 257 days (roughly 8.5 months).

In-person hearings showed a similar picture: 75-minute in-person motions averaged 185 days, and 90–120 minute in-person motions averaged 284 days, which is the longest average wait of any hearing type tracked.

That said, there were notable improvements in January 2026. Virtual 75-minute motion wait times dropped from 298 days in November to 154 days in January, and in-person 75-minute motions fell sharply from 249 days to just 89 days. These drops may reflect new dates being released in the new year.

Express Court motions saw the most dramatic improvement, falling from an average of 96 days in November to just 7 days in January 2026.

Civil Case Conferences: Wait Times Fell Dramatically

Wait times for Civil Case Conferences before a Judge dropped significantly over the period, from an average of 169 days in November 2025 to just 26 days in January 2026. The overall average was 91 days.

However, case conference dates were entirely unavailable on 17 out of 93 tracking days. Separately, Civil Practice Court before a Judge had the shortest average wait at 21 days, but dates were only bookable on 34 out of 93 days tracked — meaning that on most days, no dates were available at all.

Small Claims Court: Steady but Scarce

Toronto’s Small Claims Court non-Rule 12 motions averaged a 50-day wait, with a clear downward trend from 59 days in November to 42 days in January. Dates were available on every tracking day.

Rule 12 motions (motions for summary judgment or striking out a claim) averaged 41 days when available — but bookable dates were extremely scarce, with no dates available on 76 out of 93 tracking days (82% of the time).

First, expect lengthy waits for Associate Judge motions — plan for 6 to 9 months, particularly for longer or in-person hearings.
